What are Terms and Conditions (T&Cs)?
1.1. These General Terms and Conditions define the conditions under which the company (company name Fresh Ceramics GmbH, trade name Fresh Ceramics, “the studio” or “the company”) provides its services. The services include:
- Painting ceramics in the studio,
- Painting ceramics at home,
- Offering courses, workshops, and events,
- Open Studio,
- Gift cards,
- Providing firing services, and
- Purchasing finished goods in the Fresh Ceramics shop.
The services and offers of our company are provided exclusively based on these terms and conditions; we do not recognize any opposing or deviating conditions from our customers unless we have expressly agreed to their validity. Any contractual fulfillment actions on our part shall not be considered as consent to contractual conditions that deviate from our terms. These terms and conditions shall also apply as a framework agreement for all further legal transactions between the contracting parties.
1.2. Please read these General Terms and Conditions carefully and ensure that you understand them. If you do not agree to the terms of use, you may not become a customer of Fresh Ceramics Studio.
1.3. The company may change these terms and conditions at any time. If you continue to use our services after changes have been made to these terms and conditions and have been communicated to you, you agree to be bound by these changes.
1.4. You can view the current version of our General Terms and Conditions at any time by clicking on the “General Terms and Conditions” link at the bottom of the Fresh Ceramics website (www.freshceramics.at). It is your responsibility to ensure that you are familiar with the current terms of use. Therefore, it is recommended to regularly check the above link.
1.5. The following definitions apply in these General Terms and Conditions:
- “The company” or “Fresh Ceramics” refers to Fresh Ceramics GmbH, trade name Fresh Ceramics.
- “Studios” refer to the Vienna studios of the company at the following addresses: Westbahnstraße 18, 1070 Vienna, Austria, and from March 15 at Altgasse 20, 1130 Vienna.
- “General Terms and Conditions” refers to these General Terms and Conditions.
- “Customer” refers to anyone who uses a service or purchases a product for a fee at Fresh Ceramics Studio.
- “Courses and workshops” refer to any form of organized class for which a fee is charged.
- “Course and workshop participants” refer to any customer who has paid for a course or workshop.
- “Firing service” refers to the service provided by Fresh Ceramics, where ceramic pieces can be fired at various temperatures in professional kilns for a fee.
- “Open Studio” refers to our co-working space, which can be rented by customers for a limited time after paying a fee.
- “Fresh Ceramics Shop” refers to our shop at Westbahnstraße 18, 1070 Vienna, and Altgasse 20, 1130 Vienna, which offers a range of tools, clay, work kits, and ceramic pieces for purchase.
- “Online Shop” refers to the shop on the website “www.freshceramics.at/shop/”.
- “Week” refers to all working days in a calendar week (Monday to Saturday).
- “Usage month” refers to 4 calendar weeks.
2. General
2.1 Every customer declares and confirms to the company that all information provided by them is true and correct as of the date given to the company. Every customer is required to inform the company of any changes to their phone number or email address.
2.2 The company reserves the right to deny access to the studio.
2.3 Except in the case of children’s courses, children between the ages of 3 and 14 may only use the studio or attend a course if accompanied by a parent or a person who has been authorized in writing by the parents — and this person must also be a paying customer.
2.4 Fresh Ceramics (including its managers, employees, contractors, or other agents) assumes no liability for property damage or financial loss in cases of slight negligence, whether direct or indirect damage, loss of profit, consequential damages, delay damages, impossibility of performance, positive breach of obligation, fault at the time of contract conclusion, or due to defective or incomplete performance. The burden of proof for gross negligence lies with the injured party. To the extent that the liability of Fresh Ceramics is excluded or limited, this also applies to the personal liability of its managers, employees, contractors, or other agents.
2.5 Personal belongings are brought into the studio premises at the customer’s own risk. Fresh Ceramics accepts no liability for loss or damage to such belongings.
2.6 All information provided by Fresh Ceramics in publications and on websites is created to the best of its knowledge and belief. However, Fresh Ceramics accepts no liability for the timeliness, accuracy, and completeness of the information provided unless Fresh Ceramics is guilty of intent or gross negligence.
2.7 Fresh Ceramics accepts no liability for a specific personal learning outcome and cannot be held responsible for any individual success resulting from the courses and workshops conducted by Fresh Ceramics.
2.8 All ceramic pieces must be marked on the bottom with the customer’s initials or a symbol. Unmarked pieces will be donated by the studio’s staff after a certain period.
2.9 Despite all due care, Fresh Ceramics Studio assumes no responsibility for the loss or damage of ceramic pieces. The studio is not liable for any failures that occur as a result of the firing process.
3.1. General Provisions for Painting Ceramics
- When painting ready-made bisque ware, the general studio rules apply. Please always follow the instructions of the Fresh Ceramics staff.
- Unless otherwise agreed, painted pieces will be completed by Fresh Ceramics staff within ten days. Customers have two months to pick up their finished pieces. If not collected within this time, the pieces will be donated by the studio staff.
- You can also have your finished pieces shipped to you. Shipping fees will be provided upon request. Fresh Ceramics carefully packages all items, but the studio is not liable for any breakage or damage that may occur during shipping.
3.2. Special Provisions for Painting Ceramics in the Studio
When purchasing our bisque ware at the Fresh Ceramics Studio, the following services are included:
- Paints for decorating your piece
- A coat of transparent glaze to seal the colors
- Firing at 1040°C in a professional ceramic kiln
- Use of necessary tools like brushes, sponges, and banding wheels
- A workspace in the Fresh Ceramics Studio for the following times:
- Monday to Saturday: two hours
If bisque ware is broken or otherwise damaged during your studio time, the full retail price must be paid.
3.3. Special Provisions for Painting Ceramics at Home
When purchasing bisque ware for home painting, the following services are included:
- A coat of transparent glaze to seal the colors
- Firing at 1040°C in a professional ceramic kiln
Painted items can be dropped off at the Fresh Ceramics Studio during opening hours.
4.1. Provisions for Courses and Workshops
– “Courses and Workshops” refers to any form of organized course for which a fee is charged. Participants in Fresh Ceramics courses and workshops can only use the Fresh Ceramics facilities during the course or workshop times.
– A spot in a Fresh Ceramics course or workshop can be booked through our website using our online booking tool. At this time, it is assumed that the participant has irrevocably agreed to these terms and conditions. Courses and workshops are booked on a “first-come, first-served” basis.
– The fees for courses, workshops, and events (hereinafter “course fees”) are listed on the website (www.freshceramics.at). It is noted that Fresh Ceramics does not take responsibility for the accuracy of the listed fees, and they may vary on a case-by-case basis.
– In the case of payment arrears, Fresh Ceramics will issue two reminders and request payment of the outstanding amount. A charge of €7 will be added for each reminder. If the payment is not made within the time specified in the second reminder, the debt will be forwarded to a collection agency. The participant is responsible for all costs incurred, and they may not continue participating in the unpaid course, workshop, event, or co-making.
– Course and workshop sessions at Fresh Ceramics vary in length.
– If the course or workshop instructor is unavailable, missed lessons will be made up at no additional charge if possible. Alternatively, Fresh Ceramics reserves the right to conduct the course or workshop with a substitute instructor. If no make-up session or substitute instructor can be provided, course fees will be refunded pro-rata based on the missed lessons.
– Fresh Ceramics reserves the right to cancel courses where the minimum number of participants is not reached or for other reasons. If a course is canceled by Fresh Ceramics, the course fee will be refunded in full to the participants or a substitute date will be arranged. Partial or full refunds of course fees will be made by transfer to a bank account provided by the participants or automatically via our online booking tool.
– If the course location is changed, a special cancellation is only possible if attending the new location is not feasible due to travel time. All locations within the city of Vienna, accessible by public transport, are considered reasonable. No special cancellation rights apply if the instructor changes (especially in case of illness).
– All courses are binding and can be canceled and fully refunded up to 24 hours after successful booking.
– Changes to a booking can only be made once in the customer account. Changes to bookings made in person, by e-mail or by telephone cannot be accepted.
– A booking can be changed a maximum of 24 hours before the start of the course.
– Cancellations or rebookings made within 24 hours before the start of the course are subject to a cancellation fee of 100% of the course costs.
– Course bookings made within 24 hours of the start of the course cannot be changed or canceled.
– No-show without cancellation: 100% of the course fees
– Tickets are not person-specific and can be transferred to other people in advance if the participant does not attend.
– Cancellation of private courses:
For private courses and team events, we ask you to notify us in writing by email if you wish to change or cancel your booking:
– at least 3 months in advance for courses taking place in September – March
– at least 1 month in advance for courses taking place in April – August
Individual course places are refundable up to 24 hours in advance. The minimum number of participants for private events is 10.
Cancellation of private courses within 3 or 1 month before the start of the course: replacement date at Fresh Ceramic’s conditions, desired date can no longer be guaranteed.
– Cancellations of open studio courses: full refund possible up to 72 hours in advance, rescheduling possible up to 12 hours before the start of the course via customer account.
– Cancellation of groups of 5 or more people for ceramic painting appointments: full and partial refund possible up to 72 hours in advance, rescheduling possible up to 12 hours before the appointment via customer account.
– Cancellation of private courses within 1 month before the course start: an alternative date will be offered under Fresh Ceramics’ conditions; preferred dates can no longer be guaranteed.
– Cancellations for Open Studio spots and glazing workshops: can be rescheduled free of charge up to the start date.
– The cancellation fees listed in section 4.1.11 are due even if the course fees have not been fully paid. If the course fees have already been paid, Fresh Ceramics will deduct the cancellation fees from the course fees and transfer the remaining balance to an account provided by the participants.
– Events held at Fresh Ceramics must be paid for in advance. The registration or reservation is not transferable nor can it be exchanged for other services from Fresh Ceramics.
– If Fresh Ceramics cancels a course, the full course price will be refunded or an alternative date will be arranged.
4.2. Special Provisions for Children’s Courses
– Children between the ages of three and six must be accompanied by an adult. The child works together with the accompanying person. No sharp tools or objects are used. If the child or adult is injured, Fresh Ceramics is not liable.
– The duration of children’s courses depends on the specific course. For exact course times, please visit our website freshceramics.at.
– The following services are included in children’s courses:
– Clay for one finished piece
– The bisque firing at 980°C in a professional ceramic kiln
– Glazing by a Fresh Ceramics employee with transparent glaze
– Firing at 1200°C in a professional ceramic kiln
– Loan of tools
– A workspace in the studio for the duration of the course
– Any additional piece made costs €12 extra
– Children must also follow the instructions of the Fresh Ceramics staff.
5. Firing Service
5.1. Only authorized Fresh Ceramics staff are permitted to enter the Fresh Ceramics kiln room, load or unload the kilns, program firing cycles, or operate the kilns. Fresh Ceramics customers are required to read and follow the Fresh Ceramics health and safety instructions posted in the studio.
5.2. Despite all due care, Fresh Ceramics accepts no responsibility for the loss or damage of ceramic pieces and reserves the right to refuse the firing of items that, in the opinion of the Fresh Ceramics team, could damage the kilns themselves or other works in the kilns. The studio is not liable for any failures that may arise during the firing process.
5.3. The firing service must be paid in person and in advance during studio opening hours. Prices can be obtained from the studio management and are charged per kilogram.
5.4. Firing processes will only be carried out if a kiln is filled with an appropriate number of ceramic pieces. This decision is at the discretion of the Fresh Ceramics staff. If ceramic pieces need to be fired urgently, the available kilns can be rented as a whole for a fixed price, subject to agreement with the management. Depending on current studio occupancy and the resulting need for kilns, the time required to fire a ceramic piece may vary. Fresh Ceramics is not liable for any extended waiting times that may occur.
5.5. Individual temperature adjustments are not possible for communal firings, as the settings are chosen to achieve a general success for the most common objects and materials. A customer may book an entire kiln and arrange a personalized firing cycle for that process. The customer is required to provide detailed information about the clay bodies and glazes used for each piece to be fired. In certain cases, as determined by the Fresh Ceramics team, the customer may be asked to conduct clay and glaze tests to ensure the safety of the kilns and neighboring pieces.
5.6. Proper preparation of the ceramic pieces before the glaze firing is required. If a customer is unsure how to prepare a piece for firing, they are encouraged to consult a Fresh Ceramics staff member.
5.7. Any ceramic pieces that are not picked up within 3 months will be donated. Fresh Ceramics Studio cannot be held responsible for any ceramic pieces that are disposed of in this manner.
5.8. If the conditions are not adhered to, the customer is liable for any damages caused to the kilns or firing plates by their pieces and must cover all repair and/or replacement costs.
6. Provisions for the Sale of Handmade Ceramics
6.1. The following provisions apply to finished products that Fresh Ceramics sells in the shop or at the studios located at Westbahnstraße 18, 1070 Vienna, or Altgasse 20, 1130 Vienna. These provisions do not apply to items created by customers during courses.
6.2. If a customer of the Fresh Ceramics shop recognizes a purchased product as defective, and a Fresh Ceramics team member agrees with this assessment, Fresh Ceramics will offer either to replace the item or refund the full purchase price. Fresh Ceramics is unable to offer refunds or exchanges in other cases, unless otherwise agreed with a Fresh Ceramics team member.
6.3. Fresh Ceramics offers a 30-day return policy. If 30 days have passed since the purchase, Fresh Ceramics can no longer offer refunds or exchanges. To be eligible for an exchange, the item must be unused and in the same condition as when it was purchased by the customer.
6.4. To return or exchange an item, the customer must bring it in person to the Fresh Ceramics studio at Westbahnstraße 18, 1070 Vienna, or Altgasse 20, 1130 Vienna, during the studio’s opening hours, along with a valid proof of purchase. Items can also be returned by post to the above addresses. The customer is responsible for covering the return shipping costs. Shipping costs are non-refundable. If a customer is returning an item worth over €75, it is recommended to use a trackable shipping service or to take out shipping insurance. Fresh Ceramics Studio does not guarantee that it will receive the returned item from the customer. The customer bears full responsibility for the returned goods until they arrive at the Fresh Ceramics studio. Damaged goods occurring during return shipping cannot be refunded by Fresh Ceramics.
6.5. Ceramic products are naturally fragile. Fresh Ceramics does not offer refunds or exchanges for damaged or broken ceramic pieces.
6.6. The company strives to accurately represent and describe the products for sale. However, since the items are handmade, they may vary slightly in shape and color.
6.7. Right of Withdrawal: Participants and customers have the right to withdraw from the purchase contract within 14 (fourteen) days without giving any reason. The withdrawal period is fourteen days from the day of the contract conclusion. To exercise the right of withdrawal, participants must inform the company (Fresh Ceramics GmbH, 1070 Vienna, Westbahnstraße 18, Email: hello@freshceramics.at) through a clear declaration (e.g., a letter sent by post or email) about their decision to withdraw from the contract. If this option is used, and the declaration is properly submitted, Fresh Ceramics will promptly confirm the receipt of such withdrawal (e.g., by email). To meet the withdrawal deadline, it is sufficient for the notification of the exercise of the right of withdrawal to be sent before the withdrawal period expires.
7.1. Provisions for Online Gift Cards
7.1.1. Online gift cards can be purchased in the online shop. When purchasing, the customer must provide personal information.
7.1.2. The online gift card has no expiration date.
7.2. Provisions for Course Gift Cards
7.2.1. Course gift cards are physically available. They can be purchased during the opening hours of the Fresh Ceramics studios or ordered online in the shop.
7.2.3. The gift cards have a price guarantee for one year. After this period, there is no guarantee that the course for which the gift card was purchased will have the same price. The value of the gift card remains valid and can be redeemed for the chosen course or for other courses on our website.
7.2.4. To redeem the course gift card, a course slot must be booked in advance through our online booking tool on the website. There will be an option to enter the gift card. Each gift card has a code with the paid value, which can be entered and applied on the website.
7.2.5. The general terms and conditions listed under point 4.1 also apply when redeeming the course gift card.
8. General Terms and Conditions for the Online Shop
- The prices are in EUR plus packaging, the applicable VAT in Austria, customs duties, fees, and other public charges for export deliveries. A tax-free intra-community delivery is only possible for traders who provide a valid VAT ID number.
- Until all claims against the customer have been settled, the delivered goods remain the property of Fresh Ceramics. If Fresh Ceramics replaces goods under the warranty, the customer must promptly return the originally delivered goods.
- Generally, goods are shipped to end customers only upon prepayment.
- The delivery and shipping costs per delivery can be inquired in advance. The delivery of goods is at the customer’s risk and expense, from the warehouse to the delivery address provided by the customer. The risk passes to the customer as soon as the delivery is handed over to the carrier by Fresh Ceramics or its agent, even in cases of partial deliveries. Delivery times are non-binding.
- Fresh Ceramics delivers the ordered goods or services after accepting the offer. If Fresh Ceramics later realizes that, for example, there was an error in the product details, price, or delivery, the company will immediately inform the customer. The customer can confirm the order under the amended conditions. Otherwise, Fresh Ceramics has the right to withdraw from the contract.
- Fresh Ceramics contracts only with customers, entrepreneurs, and legal entities of public law with their registered office in Austria or a Member State of the European Union.
- Scope of application: Our following general terms and conditions apply to all personal, written, electronic (internet, new media), and telephone orders in their valid form at the time of the order and are acknowledged by the customer with each order. Deviating terms from the customer are not recognized by Fresh Ceramics unless Fresh Ceramics has expressly agreed to their application in writing.
- No liability is assumed for the accuracy and completeness of the content on Fresh Ceramics’ websites.
- The contract for an offered item or service is concluded without a declaration from the customer by the actual execution by Fresh Ceramics. The customer waives the declaration of acceptance (§864 ABGB). The customer is either informed of the acceptance of an application for contract conclusion by Fresh Ceramics through a confirmation or, at the latest, through the execution of the delivery of the ordered goods or the offering or provision of the service. In the case of distance selling, the customer can withdraw from the concluded contract within 14 days after receiving the goods by sending a written declaration of withdrawal. It is sufficient if the withdrawal is sent within this period. The customer is obliged to promptly return the goods. The customer bears the return shipping costs (postage) unless the customer received incorrect or defective goods. The customer can exercise this right of withdrawal by returning the goods within 14 days after receipt without stating a reason. To meet the deadline, it is sufficient to send the goods back in time. The goods must be undamaged, unused, and sufficiently stamped for the return. Only in the case of incorrect or defective deliveries does Fresh Ceramics cover the return shipping costs (postage). The risk of shipping and the proof thereof lies with the customer. If Fresh Ceramics is no longer supplied with the ordered goods by the supplier despite contractual obligation, Fresh Ceramics can either offer or deliver goods or services of equal quality and price, or withdraw from the contract.
- The company makes every effort to accurately depict and describe the products for sale. However, since the goods are handmade, they may vary slightly in shape and color.
- Fresh Ceramics guarantees that the products at the time of shipment or when handed over in the store are free of defects that would diminish their value or suitability for their normal use. An insignificant reduction in value or suitability is disregarded. The customer must immediately check the goods upon receipt for completeness or any defects, no later than within a week of receipt, and immediately send a defect report if any deviations are found. For hidden defects, the report must be made immediately after discovering the hidden defect within the warranty period. Compensation is provided according to § 933 of the ABGB. Fresh Ceramics is not liable for damages not directly caused to the delivery item itself; in particular, Fresh Ceramics is not liable for lost profits or any other financial losses of the customer. A warranty cannot be provided for defects caused by improper use or excessive wear by the customer. Fresh Ceramics is liable in cases of positive breach of contract, fault at contract conclusion, delay, impossibility, tort, and other legal grounds only in cases of intent or gross negligence. The same applies to consequential damages. Indirect damages (third-party damages) are generally excluded. If Fresh Ceramics’ liability is excluded or limited, this also applies to the personal liability of employees, representatives, and agents. If Fresh Ceramics violates an essential contractual obligation, the liability for material or personal damages is limited to the typical damage that could arise. Data processing systems and software do not always work error-free according to current technical standards. Accordingly, Fresh Ceramics cannot guarantee the flawless operation of the online shop. Additionally, the uncertainties of the internet itself must be considered. Fresh Ceramics is not liable for damages resulting from technical deficiencies, such as if purchase offers made by customers do not reach Fresh Ceramics or are not considered. The above regulations represent the full scope of Fresh Ceramics’ liability. Any further liability is excluded.
- Austrian law applies to the legal relationships between Fresh Ceramics and customers, as well as the respective business conditions. The application of the UN Convention on Contracts for the International Sale of Goods (CISG) from April 11, 1988, is excluded.
- Fresh Ceramics guarantees that the customer data collected in connection with orders will only be processed, stored, and used in connection with order processing and will only be shared with affiliated companies for order fulfillment. Fresh Ceramics will not use or share customer data beyond this scope. The customer may request the deletion of their data at any time. Data protection law: The protection of your personal data is particularly important to us. We therefore process your data exclusively based on legal provisions (GDPR, TKG 2003). In these data protection provisions, we inform you about the most important aspects of data processing in the context of our website.
- If you contact the company via a form on the website or by email, the data you provide will be stored for processing the inquiry and for follow-up questions for 12 months. This data will not be shared without your consent.
- We would like to point out that, for the purpose of easier shopping and for later contract processing, the webshop operator stores the IP address of the connection holder, as well as the buyer’s name, address, and payment method through cookies. The data you provide is necessary for the fulfillment of the contract or the implementation of pre-contractual measures. Without this data, we cannot conclude the contract with you. Data will not be transmitted to third parties except for the transmission of credit card data to the processing banks/payment service providers for processing the payment, to the transport company/shipper to deliver the goods, and to our tax advisor to meet our tax obligations. After the shopping process is aborted, the stored data is deleted. In the case of a contract conclusion, all data from the contractual relationship will be stored until the end of the statutory retention period (7 years). The data (name, address, purchased goods, and purchase date) will be stored until the end of the product liability period (10 years).
- Fresh Ceramics uses cookies on the website. These are small text files that are placed on your device through the browser. They do not cause any damage. We use cookies to make our offer more user-friendly. Some cookies remain stored on your device until you delete them. They allow us to recognize your browser on your next visit. If you do not wish this, you can set your browser to inform you when cookies are set and allow them only on a case-by-case basis. Disabling cookies may limit the functionality of our website. Your IP address is collected but is immediately pseudonymized (e.g., by deleting the last 8 bits), making only a rough localization possible.
- Your rights: You generally have the rights to access, rectification, deletion, restriction, data portability, withdrawal, and objection. If you believe that the processing of your data violates data protection law or that your data protection rights have been violated in another way, you can file a complaint with the supervisory authority. - The customer does not have the right to offset or withhold unless the claim is undisputed or legally determined by a court. The customer’s rights under § 1052 ABGB remain unaffected. The place of performance for both delivery and payment is the business address of Fresh Ceramics, Westbahnstraße 18, 1070 Vienna, Austria.
- The exclusive place of jurisdiction is Vienna or another statutory place of jurisdiction at the discretion of Fresh Ceramics, provided the customer is a merchant in the sense of the HGB or a public-law entity. If individual provisions of the contract are entirely or partially ineffective or lose their legal effectiveness, the validity of the remaining provisions is not affected. In this case, the parties undertake to agree on an effective provision that, as far as legally possible, comes closest to the economic purpose pursued by the ineffective provision, taking into account the interests of both parties expressed in this contract. The same applies if the contract has a gap not anticipated by the parties.
9. Compensation for Damages
9.1. The inventory, premises, media, and equipment of the Fresh Ceramics Studio must be used and treated with care. Any damage must be reported immediately.
9.2. Course and workshop participants are liable for all damages they cause and are therefore obliged to compensate for such damages.
10. Data Protection
10.1. Fresh Ceramics takes care of the data and ensures its security. We process this data in accordance with the GDPR, the Austrian Data Protection Act (DSG 2018), and the TKG. Further information can be found in the Fresh Ceramics Privacy Policy.
11. Copyright
11.1. The contents of the provided scripts, documents, and materials are protected by copyright and are exclusively for the personal use of Fresh Ceramics customers. Any further use, particularly storage, duplication, translation, processing, and any form of commercial use, as well as passing on to other persons – even in part or in modified form – without the consent of the authors is prohibited.
11.2. Images, graphics, and texts on the Fresh Ceramics website (www.freshceramics.at), as well as on any Fresh Ceramics publication and advertising material, are subject to copyright. Reproduction, editing, publication, or any other form of use is only permitted with the express consent of the Fresh Ceramics Studio.
11.3. Participants undertake to hold Fresh Ceramics harmless in the event of copyright claims arising from infringements of copyright.
12. House Rules, Health, Safety, and Cleaning
12.1. All customers are required to strictly follow the studio guidelines. These may be amended from time to time and should be consulted regularly. Fresh Ceramics customers commit to following the instructions of the studio staff to ensure smooth operations without exception.
12.2. Course or workshop participants use the Fresh Ceramics studio at their own risk and in full knowledge of the associated dangers of a workshop environment. This includes, but is not limited to, the use and handling of sharp tools and objects, dealing with potentially toxic or harmful materials, the hazards of processing such materials, and the associated risks of inhaling silica dust.
12.3. Every course participant or workshop participant must read and follow the health and safety information. In addition, all customers and members must at all times follow and comply with all health and safety instructions from the company or studio staff.
12.4. Customers must use the main entrance when entering or leaving the studio. In the event of a fire, customers are requested to exit the studio via the nearest available exit.
12.5. Smoking is prohibited in the studio.
12.6. All course or workshop participants agree to spend at least 20 minutes cleaning the studio at the end of each session. Inhalation of clay and glaze dust is harmful to health, and it must not be left behind in the studio. The work areas, including the floor, must be kept clean after use without exception.
13. Legal Form
13.1. Fresh Ceramics GmbH (trading name: Fresh Ceramics) is a limited liability company based in Vienna, with the business address at 1070 Vienna, Westbahnstraße 18, registered in the Commercial Register of the Commercial Court Vienna under FN645419 and with the VAT number ATU81702418.
14. Law and Jurisdiction
14.1. This agreement is governed by Austrian substantive law.
14.2. The exclusive place of jurisdiction for all disputes arising from or in connection with these terms and conditions is – unless § 14 KSchG provides for something different – the court responsible for Vienna.
